When those situations arise, access to qualified inspection, assessment, and remediation professionals is an important resource for both the agent and the client.
The REALTOR®'s job isn't to diagnose the problem. It's to recognize when a concern may require an appropriately qualified professional. These situations tend to surface during a buyer's inspection, while a seller prepares to list, in an attic or HVAC system, after a roof or plumbing leak, where there's evidence of previous flooding, or simply when a client notices staining or a musty odor and asks what it means.
Worth knowing in Texas
Mold assessment and mold remediation are regulated by the Texas Department of Licensing and Regulation. Certain mold-related activities require appropriate licensing, and the credentials needed depend on the specific service being performed. Verify licensing for the particular service you're referring, not just that the company works in mold.
Assessment and remediation are not the same service. Evaluating a potential mold condition and performing the remediation work involve different licensing, procedures, and documentation, and Texas rules address the relationship between the two roles on the same project. This is one more reason to work with professionals who understand the regulatory framework around their own work — and to confirm scope directly with each provider.
Protect your client without becoming the expert
One of the biggest liability concerns for an agent is unintentionally becoming the "expert." Avoid diagnosing what you see, or making representations that aren't supported by an appropriate professional. Agents are problem solvers, and that instinct usually serves clients well. Environmental concerns are the exception — the best solution is often bringing in the right professional rather than supplying the answer yourself. Avoid prescribing remediation methods, estimating costs, deciding whether testing is necessary, interpreting laboratory results, or telling a client a property is safe.
